Abstract

On June 7, 2012, the Ministry of Water Resources published its Draft National Water Policy 2012 (NWP).  The Draft Policy seeks to address issues such as the scarcity of water, inequities in its distribution and the lack of a unified perspective in planning, management and use of water resources. Under the Constitution, states have the authority to frame suitable policies, laws, and regulations on water (Item 17 in List II of the Seventh Schedule or the State List). The NWP proposes an overarching national legal
framework of general principles on water that can used by states to draft their own legislation on water governance.  The draft NWP was was placed before the National Water Board and National Water Resources Council in February 2012.  It was finalized and adopted by the National Water Resources Council on August 9, 2012 and is under deliberation by the National Water Board.
